The real issue with Michael Flynn's from resignation Homeland Security is not a possible violation of
the Login Act (a law that has never been charged). Rather
what is emerging as a shadow government made of Obama operatives left behind by Obama when he
left office. The idea that rogue intelligence officers working for the
US intelligence department forwarded highly sensitive (and a possibly
classified conversation) to the press, for the sole purpose of
destabilizing a new Presidents Administration, smells of a criminal
conspiracy. This is not the same as someone hacking into someones email
account by guessing the password. This is US intelligence officers
using information gleamed using highly invasive NSA technology to be
used for Homeland Security, that is strictly controlled to preserve the
peoples constitutional rights (the use of such information requires a
court order), for a political assassination.
It is presumed that Flynn was recorded by US intelligence that was
monitoring telephone calls to the Russian government. The law as I
understand it says, that once the phone call was captured, the
intelligence operators must get a court order to continue any
investigation becasue it involved a US citizen. However, some rogue US
intelligence officer bypassed this constitutional barrier, pretty much
doing what Eric Snowden has been convicted of; the release of classified
and/or sensitive intelligence information without permission.
As of now only the FBI, Trump and probably the person that leaked it to
the press, have a transcript, however, some that have seen the transcript
say Obama's sanctions against Russia were mentioned, but not discussed;
something along the lines of the Russian saying he wanted to talk about
what the Trump Administration was going to do about the Obama sanctions
and Flynn told told the Russian that was something he would have to
take up with Trump. So it's false news that any law was violated. Where
Flynn screwed up is he told Vice President Mike Pence the subject of the sanctions never
came up in the phone call with the Russians, resulting in Pence
defending Flynn based on Flynn's denials. However it turned out Flynn lied to Pence (or the very least was not forth coming) and left Pence
hanging with his lack of candor. If the Trump Presidency is to succeed,
all of his cabinet and advisers have to be on the same page. As a
supervisor I often explained that I would do whatever I could to back my officers up when mistakes that are made, as long as they were honest mistakes. But
there are two things that are in their best interest; 1) be completely
honest (ie don't make me look stupid defending you) and 2) let me hear
about it first from you; I don't like surprises. Flynn broke both
rules, which pretty much showed him not to be the team player he needed
to be and Trump said so much. So the issue was not so much a violation of decorum or even the law, Flynn made Pence look bad as Flynn violated an expected level of trust, so he had to go.

There (is) an Undeniable Nexus Between Islamic Doctrine and Terrorism Committed by Muslims
No one I know believes that all Muslims are terrorists; however anyone with a good knowledge of Islam can not help to come to the conclusion that the terrorism perpetrated by Muslims, that we see in the world today, is legitimized in Islamic scripture; it is also false that there are "There was no justification in the Koran" for Islamic terrorism", there are also other holy books of Islam that has the same fiery language. As Former Assistant U.S. Attorney Andrew McCarthy, who prosecuted the “Blind Sheikh” Omar Abdel Rahman, has written in his book, he first thought he would be prosecuting a terrorists that was using some bastardized version of Islam to justify his terrorism. However as he studied the Koran and other Islamic holy books, he discovered the opposite.

Further most of the Muslim refugees coming to European countries are men; "About 62% of all migrants that have traveled to Europe this year, however, are men. A little under a quarter, 22%, are children and only 16% are women. http://time.com/4122186/syrian... It is also true that only half are from Syria. It would surely make sense to put a temporary hold on Muslim refugees coming into the US until Homeland Security and/or the FBI can properly vet them (the FBI was said they have no basis to vet most of the refugees). While the registering of Muslim US citizens would be highly problematic, a hold on new refugees and closer scrutiny of those already here is well within the scope and authority given to a US President from the "Immigration and Nationality Act of 1952" (this is what President Carter used to stop Iranians from entering the country during the Iranian hostage crisis (1979-1981). It should also be noted that all refugees are asked their religion as it is a major component of refugee status when coming to the US.
Finally it should be noted that President Obama has instructed DHS not to use social media to vet Muslim immigrants and/or refugees seeking visas; this is rationalized by the President saying social media is more based on religious beliefs and believes that "actions" are the only thing that counts as far as vetting Muslim, not the posting of violent Islamic extremism or a disdain for America and Democracy for fear of a "civil liberties backlash and "bad public relations"" with the Muslim community at large. http://abcnews.go.com/US/secre...

President Obama Does Not Have the Authority to Ignore Immigration Law;
To believe the President Obama has the authority to ignore Immigration law via prosecutional discretion, is to believe that prosecutional discretion trumps the Constitution Article II's, Take Care Clause, which requires that the President "shall take Care that the Laws be faithfully executed."

Presidents could simply decide not to enforce entire sections of the Clean Air Act, tax code or labor laws, or exempt entire categories of people — defined unilaterally by the president — on the assertion that those laws are "unfair" and there aren't enough resources to go around. The president would have power to grant a "privilege" or exemption from any federal law, defying the plain language those laws and the will of the people's Congress. The projected executive action (EA) by President Obama, if signed, will be doing the illegal immigrants all ready in this country a great disservice. In previous cases President Regan and Bush used an EA that addressed omissions in existing immigration legislation, that did not cover the children of illegal aliens that were allowed to stay in the country to pursue legal status. In other words the EA addressed issue in an existing law and unlike President Obama's EA, did not create a new law, which is unconstitutional. The EA also does not carry with it the same authority of a law voted in by Congress and signed by the President; this EA will simply be a directions to Homeland Security (via prosecutional discretion) to stop deportations of illegal immigrants already in the country, but prosecutional discretion does not legalize a violation of the law, it simply says in this specific case justice is otherwise served by not prosecuting a law breaker. This means that Obama's projected order does not change the fact that the illegal immigrants in the US will still be violating the law; so this security blanket could quickly be pulled out from under these same immigrants by a court order or the whim of the next President. In this case illegal immigrants will continue to live in the shadows not knowing what is going to happen to them as there is no law behind the President EA.
Consider the President has already shorted ICE with the money and agents necessary for deportations. President Obama’s budget would rewrite the federal government’s interior immigration enforcement priorities, cutting funding for states that try to help enforce immigration laws and scaling back the number of immigrants the federal government will detain while they await deportation. He sent the proposal to Capitol Hill on Wednesday, at a time when congressional lawmakers are trying to write a broad immigration bill to bolster border security and interior enforcement, and to screen millions of illegal immigrants who could gain legal status under the legislation. All of that will cost money, but Mr. Obama’s budget cuts overall funding for the Homeland Security Department. It particularly trims interior enforcement initiatives, such as the State Criminal Alien Assistance Program, which has widespread support among members of Congress...Ms. Napolitano’s budget boosts spending by $1.1 billion for U.S. Customs and Border Protection, which includes the Border Patrol and officers who watch the ports of entry. But it reduces by nearly $650 million, or 11 percent, funds for U.S. Immigration and Customs Enforcement, which handles interior investigations and deportations. There is also the effect the President's EA will have on blacks and other minorities. "As immigrants disproportionately increased the supply of workers in a particular skill group, the wage of black workers in that group fell, the employment rate declined, and the incarceration rate rose. Our analysis suggests that a 10-percent immigrant-induced increase in the supply of a particular skill group reduced the black wage by 4.0 percent, lowered the employment rate of black men by 3.5 percentage points, and increased the incarceration rate of blacks by almost a full percentage point." Another issue not being reported on is how President Obama's Executive Amnesty will continue the victimization of illegal aliens. Since the majority of Americans are already against amnesty without even experiencing the inevitable hardships it will cause, the left will again allow the focus of their unpopular agenda to be scapegoated. When one considers that Americans have yet to feel the full effect of ObamaCare, which has never been popular to begin with, the Presidents actions now will likely guarantee the next president will have to run on revoking both the President Obama's EA on immigration and ObamaCare as well. And of course that doesn't even consider the likelihood that once Obama's Executive Amnesty is in place, he will announce another EA to give healthcare to the illegal aliens in the country, now protected from deportation. Whatever happens there will surely be a collective sigh of relief (that has not been heard since Woodrow Wilson's time) once this lame duck President is finally gone.

Napolitano, David Broder and Dangerous Underwear
David Broders puff piece on Janet Napolitano seems to be another attempt by the liberal media to present the opposite as truth. Never mind that anyone who is paying attention knows, that Ms Napolitano is so far out of here element, that through no fault of her own, she is simply too incompetent to hold her postion as the Secretary of Homeland Security. Practically everything that comes out of her mouth of any substance, has had to be retracted and apologized for. Broders contention that it was proper for Napolitano to say, “the system worked”, flies in face that her boss, President Obama said the “Underwear Bomber” near success was a result of “systematic failure"; to which Napolitano retracted her original statement and admitted, "Our system did not work in this instance." This is the same person who said we should improve security at the Canadian Border to stop more 911 terrorist from sneaking across (they didn't) and that the FBI and local law enforcement needed to keep an eye on returning vets because they were “prone to radicalization”. Interestingly enough, we still don't know if it was Homeland Security or the State Department under Hillary Clinton, that caused the problem. Homeland Security is supposed to be an intermediary between the FBI and the CIA, and to distribute Homeland Security information to prevent a re-occurrence of 911; where the CIA was forbidden to share the information with the FBI about the Saudi Terrorist and friends of Osama Bin Laden, that were taking flying lessons. Later Homeland Security was given oversite of the Transprotation Security Administration. Like many of his choices, Pres Obama appointed Ms Napolitano, not because she has any intelligence experience or even understands the threat of terrorism (a word she refuses to even use, preferring “man-caused disaster”), but for political payback. There is no more important job than the head of Homeland Security, but you have to be able to say there is terrorism, before you can defend the country from terrorist. Homeland Security is not the job for a budding politician on the rise and her continued presence as the Head Secretary is putting your and my homeland in real danger.
